Music Video Promotion and Distribution Terms of Service

You confirm that you are 18 years of age or older and are competent to enter into the terms, conditions, and representations set forth in this Terms of Service.

A) Time-Frames

Express Plan – 3 to 5 business days upon receipt of the raw video from the AK Music online drop-box or received by postal mail AND the completed information form.

Premium Plan – 5 to 7 Business Days upon receipt of the pictures from the AK Music online drop-box Audio (MP3’s), AND the completed information form.
NOTE: 20 Photos are required for each minute of music.
Editing for text overlays (artist or band names, genres, web address and phone number) requires a sign-off within 3 days, otherwise the video will be distributed as is. Any change to the video after the client has signed off will incur a fee of $50.00 per change.

Deluxe Plan – 5 to 7 Business Days upon receipt of the pictures from the AK Music online drop-box Audio (MP3’s), AND the completed information form.

B) Copyrights

IWest Internet LLC and AK Music Video respects copyright and trademarks. You agree that you are the legal owner of all images, video, and audio or that you have legal authorization to the images, video and audio submitted to AKMusic Video for video promotion and distribution.

C) Billing

The Video Maintenance Service Plan is billable in advance each month and begins with the purchase of this service. Recurring payments are billed automatically with the exception of annual Service Plan payments. Canceling your Video Maintenance Service Plan account will stop all future billings, but prior billings are non-refundable.

D) Cancellation

This service may be canceled at any time. Due to the amount of work involved to set up, promote, and distribute the video, the Set Up Fee for all Music Video Promotion Packages is NON-REFUNDABLE. Canceling your hosting account will stop all future billings, but prior billings are non-refundable.

E) Disclaimer of Warranties

You acknowledge that the Music Video Promotion Service is provided to you on an “as is” basis, without any warranty of any kind, express or implied, including but not limited to implied accuracy of informational content.

F) Limitation of Liability

You agree to hold harmless and indemnify IWest Internet LLC and AKMusicVideo.com, its employees, agents, representatives and third-party content, distribution, advertising or other strategic partners for any consequential, indirect, special, incidental, or exemplary damages arising out of or relating to this agreement or the IWestInternetLLC/AKMusicVideo.com services, whether foreseeable or unforeseeable, and whether based on breach of any express or implied warranty, breach of contract, misrepresentation, negligence, strict liability in tort, or other cause of action (including, but not limited to, damages for loss of data, goodwill, profits, investments, use of money, or use of facilities; interruption in use or availability of data; stoppage of other work or impairment of other assets; or labor claims), even if such party has been advised of the possibility of such damages.
